An owner of one of the two pit bull terriers that mauled to death a miniature schnauzer last month was fined a total of $500 for not having his dog on a leash and for the dog biting another animal.

Jonathan Kuperus told Monroe County Judge W. Reagan Ptomey at an Oct. 13 hearing that he took full responsibility for his dog’s attack on the schnauzer, a 4-year-old named Max and apologized to Max’s owner, Ileana Morales.

Morales was walking her dog on a leash on Sept. 23 when Kuperus’ female dog and a male pit bull belonging to his former girlfriend, Erin Woods, attacked Max.

The attack happened on Plantation Boulevard in the Plantation Beach subdivision. Morales said the pit bulls ran out of Woods’ house as she opened the door when she returned from work. She said the dogs grabbed either end of Max and tore him apart. Woods did try to wrestle one of the dogs off Max, Morales said.

Kuperus told Ptomey that he plans to move his dog to his parent’s home in South Carolina, where they own many acres of land for it to roam. They also have pit bulls, Kuperus told Ptomey.

Kuperus complained about a Monroe County Animal Control designating his dog a “dangerous animal,” which he said will make his parents’ homeowners insurance higher.

Ptomey told Kuperus he saw no reason to lift the designation since Kuperus’ dog killed another pet.

“There’s plenty of smoke by the time this gets to me. This should suggest that there is a problem with your animal,” Ptomey said.

Kuperus and Woods wouldn’t talk to The Reporter following Ptomey’s ruling. A visibly upset Morales said she did not want to discuss the decision.

Ptomey recused himself from Woods’ case when he found out she was being represented by her father, Tavernier attorney Tom Woods. Ptomey said that he knew Tom Woods too well and any decision he made could look inappropriate.

“If I don’t find her guilty, it’s going to look like I’m doing her a favor,” Ptomey told the courtroom.

Erin Woods is facing the same civil infractions as Kuperus. He said his dog would not have attacked if he had been home the night of Sept. 23. Kuperus testified he and Woods broke up two months before the attack, but the dog was staying with Woods because his rental home in Key West did not allow pets.

He said Sept. 23 was the first time his dog attacked anything in the six years he owned it. But witnesses testifying on behalf of Max’s owner said otherwise.

Howard and Lynda Kolbenheyer said their 4-year-old yellow Labrador retriever, Roscoe, was almost killed by the dogs on May 27. Howard Kolbenheyer, who lives on Seaside Avenue in Key Largo, said the dogs were unleashed in the back of Woods’ truck when Woods was visiting her father, who lives near the Kolbenheyers.

Lynda Kolbenheyer said she was walking Roscoe on a leash when the dogs jumped out of the truck and pounced on him. Kolbenheyer said Kuperus was able to restrain his dog, but Woods’ dog “tossed” 94-pound Roscoe around “like a rag doll.” A neighbor ran to get a gun while another beat the pit bull in the head with a piece of rebar to no avail.

The man was finally able to pry the dog’s jaws open with the rebar, but he kept attacking until the man forced the bar down his throat long ways, Kolbenheyer said.

Roscoe suffered puncture wounds to the neck and received multiple antibiotic treatments.

Woods’ case will likely be taken up by a county judge in Marathon next month, Ptomey said.

Woods and Kuperus also faced civil infractions for not having updated pet vaccination records. Kuperus has since updated his dog’s records, Michael Coleman of Animal Control, said.

Since you already have a Jack Russell, I won't give you the ideal lecture on terriers and why most people shouldn't own them! Mini bulls are neat dogs, but the white ones do have the same discompose with occasional deafness. And they are very rare breed, so you may have to travel farther. Find a good breeder by going to www.akc.org or talking to people at dog shows.

Go to AKC shows in the room(there are listings at the AKC site & infodog .com) & talk to the people who actually KNOW their breed.
